General Terms and Conditions of Sale

1 - Legal Notice

The website www.tomarcreation.com is the sole property of Charline Moulin (individual entrepreneur), including all related rights.

Any reproduction, in whole or in part, is systematically subject to the owner's authorization.

2 - Purpose

These terms of sale aim to define the contractual relationship between Tomar Creation and the Customer, as well as the conditions applicable to any purchase made via Tomar Creation's websites. These conditions exclusively concern non-commercial individuals. Any order implies adherence to these General Terms and Conditions of Sale (GTCs).

Subject to any contrary legal provisions, the GTCs applicable to the relationship between Tomar Creation and the Customer are those in force on the day the order is validated. They apply to the exclusion of all other conditions.

3 - Characteristics of Goods and Services Offered

We do our best to satisfy you. On this website, we present all the essential characteristics of the goods. Products are made to order within the limit of available materials.

Each product is accompanied by a description prepared by Tomar Creation. The photographs in the catalog are as accurate as possible but cannot ensure a perfect resemblance to the product offered, particularly concerning colors and unique personalized creations.

4 - Prices

The prices of our products are indicated in Euro, all taxes included (no VAT applicable). They include the processing fees for your order. Shipping costs will be indicated to the customer before final registration of the order.

Products will be invoiced based on the prices in effect at the time the order is registered, with payment due in Euro and in a single installment. Prices may be modified at any time by the seller without prior notice. Goods delivered remain the property of Tomar Creation until full payment is received.

5 - Purchase Process

Customers can order online via the website www.tomarcreation.com or by email info@tomarcreation.com.

To place an online order, the customer must:

  • Fill their cart, providing all details about the desired products (quantity, size, and other available options).
  • Complete the identification form, providing all requested contact details or their customer number.
  • Confirm their order after verification.
  • Make payment under the specified conditions.

Confirmation of the order and its payment implies acceptance of these terms of sale, acknowledgement of having full knowledge of them, and waiver of any other conditions.

After validating the order, Tomar Creation will send a detailed summary by email, making the sale final. Tomar Creation undertakes to fulfill received orders and to inform the customer as soon as possible of any reasons that might invalidate the order (missing materials, unfeasible model composition). The product may either be modified or refunded, upon agreement with the customer.

6 - Payment Methods

Payment for purchases can be made at the customer's choice:

  • By bank transfer.
  • By credit card, via the «STRIPE" or Paypal system.
  • By Paypal, via a Paypal account or all credit cards.

Products are manufactured after receipt of payment. If payment is not received within 10 business days, Tomar Creation reserves the right to cancel the customer's order.

7 - Shipping and Delivery Time

Generally, the customer receives their package 5 to 15 days after payment of the order.

Items are manufactured and shipped from our Tomar sewing workshop within 2 to 30 business days from the order date. Exceeding this period cannot in any case be held against Tomar Creation, nor lead to termination of the contract or any compensation for damages. Tomar Creation makes every effort to respect the deadlines mentioned on its website. Beyond a shipping period of 30 days, Tomar Creation will refund the merchandise or renew the order in agreement with the customer.

Packages are delivered to the delivery address indicated during the order, by registered mail via La Poste within 8 to 20 business days from the shipping date, by GLS under 5 days (European carriers). Deliveries are worldwide. From the moment the package is handed over to La Poste, Tomar Creation can not be held responsible for any unforeseen circumstances related to the shipping method. For information, tracking on the French postal service website is only accessible once the package enters French territory, i.e., 2 to 4 days after dispatch.

8 - Withdrawal Period and Right

In accordance with legal provisions, the right of withdrawal can not be exercised for products made to order according to the customer's specific requirements such as unique personalized creations.

For other products, the customer has a period of 14 business days from the date of receipt of the merchandise to exercise their right of withdrawal from their order. The return or cancellation can concern all or part of the order. Return or size exchange shipping costs are at the customer's expense. Beyond the 14-day period from the receipt of the package, goods will not be taken back, exchanged, or refunded.

Full or partial reimbursement will be made within a maximum of 15 business days following Tomar Creation's receipt of the returned merchandise. Reimbursement will be made by bank transfer or by check payable to the customer, in accordance with the information provided during the order. Products returned damaged, incomplete, soiled, or without their original packaging will not be taken back, exchanged, or refunded.

9 - Returns and Refunds for Customers Outside the European Union

For returns of goods made by customers residing outside the European Union, the refund conditions are as follows:

Initial Shipping Costs: The shipping costs paid during the initial dispatch of the order will not be refunded.

Return Shipping Costs: Shipping costs related to the return of the package by the customer are at their expense and will not be reimbursed by us.

Customs Duties and Import Taxes: Any customs duties, import taxes, or other similar charges that we may have to pay to retrieve a package returned from a country outside the European Union (e.g., customs fees for a package from Switzerland) will not be reimbursed to the customer and will be deducted from the refund amount due.

We invite you to read these conditions before proceeding with a return from a country outside the European Union.

10 - Returns and Refunds for Customers Within the European Union

For our customers residing within the European Union, the refund conditions are as follows:

Product Refunds: The price of the returned product(s) will be fully refunded to you, provided that the products are returned in their original condition and show no signs of use or damage.

Initial Shipping Costs Refunds: The standard delivery costs (GLS and post) you paid during your initial order will also be refunded to you. If you chose a more expensive delivery method than standard delivery (e.g., express delivery), only the portion corresponding to the cost of the standard delivery will be refunded.

Return Shipping Costs: The shipping costs related to the return of the package are at your expense and will not be reimbursed by us.

Return Procedure:

To exercise your right of withdrawal, we invite you to inform us of your decision in writing (email, mail) before the expiration of the 14-day period. You must then return the product to us as soon as possible and no later than 14 days after your notification of withdrawal.

11 - Protection of Personal Data

The information you provide to us is essential for processing and delivering orders. Tomar Creation is authorized to use your personal data for order fulfillment. You have a permanent right to access and rectify all data concerning you. If you accepted it during your identification on the Site, emails offering new products, exclusives, or promotional offers will be sent to you. You can request to stop receiving emails from us at any time by clicking on the link provided for this purpose.
